Terms & Conditions of Sale

1. Introduction

Welcome to Gemstone Diamond Empire. These Terms & Conditions (“Terms”) govern the sale of diamonds, jewelry, and related services to wholesale and retail customers. By purchasing from us, you agree to abide by these Terms.

2. Eligibility to Purchase

You must be legally able to form binding contracts in your jurisdiction to place orders with us. We sell to both:

Wholesale buyers (jewelers, resellers, B2B)

Retail customers (individual clients for personal use)

3. Products

We offer:

Loose diamonds (natural and lab-grown)

Melee diamonds and parcels

Fancy color stones

Custom-designed jewelry (made to order)

Diamonds above 1.00 carat are certified (IGI/GIA). Smaller stones are generally uncertified.

4. Orders & Custom Work

Orders are confirmed once full payment (or deposit for custom work) is received.

Custom orders require a deposit and are non-refundable once production has begun.

We reserve the right to refuse or cancel orders at our discretion.

5. Pricing & Payment

All prices are shown as ranges due to fluctuations in market pricing.

Final quotes are confirmed via WhatsApp or email.

Accepted payment method: Interac e-Transfer (Canada) or Bank Transfer.

No taxes are charged at this time. All import/customs duties are the buyer’s responsibility.

We reserve the right to introduce applicable taxes once the business is formally registered.

6. Shipping & Delivery

We ship to most countries using FedEx, UPS, or equivalent insured services.

Delivery time is typically 8–12 business days for loose stones.

Free shipping is provided on orders over $500 CAD. Orders under that may incur a shipping fee.

Customers are responsible for import taxes, customs fees, or duties imposed by their country.

7. Risk of Loss

All items are shipped with insurance and tracking. Risk of loss transfers to the buyer upon delivery confirmation.

8. Returns & Refunds

Retail customers may request returns for non-custom items within 15 days of delivery.

Wholesale clients must report any discrepancies within 48 hours of receipt.

Custom orders are final sale, except in cases of manufacturing defects.

Returns must be approved in advance and shipped back using trackable, insured methods.

9. Warranty

We guarantee the authenticity and quality of all diamonds and jewelry sold.

Covered:

Manufacturing defects

Loose stones within 30 days (retail)

Mislabelled specifications

Not Covered:

Wear and tear, accidental damage, misuse, loss, theft, or third-party repairs

10. Resale & Branding

Buyers may resell items purchased from us under their own brand, provided the items are not misrepresented.

11. Intellectual Property

All content on our website, including product images, text, and branding, is owned by Gemstone Diamond Empire and may not be reused without permission.

12. Limitation of Liability

We are not liable for any indirect, incidental, or consequential damages. Liability is limited to the amount paid for the product in question.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of Canada. In case of any dispute, both parties agree to resolve it through binding arbitration before seeking legal action in court.
